1. About Upcomers Platform

Upcomers is a proprietary trading firm that provides traders with access to evaluation programs. Participants can register on the platform, trade under predefined conditions, and qualify for funded accounts upon successful completion of trading challenges.

This Giveaway is organized and administered by Evernest Capital a.s., a Czech company registered under ID No. 09696105, with its registered office at Na Folimance 2155/15, Vinohrady, 120 00 Prague, Czech Republic, in cooperation with Upcomers.
Evernest Capital a.s. is responsible for the organization, management, and drawing of the Giveaway.

This Giveaway is organized and administered outside the United Arab Emirates.It is not intended to be conducted under UAE law and is not subject to UAE promotional regulations.This Giveaway does not constitute a lottery, gambling, or prize draw under UAE law, and residents of the United Arab Emirates are not eligible to participate.

2. Eligibility

Participation in the Win Trip to Dubai Giveaway (the “Giveaway”) is open to individuals who successfully complete and pay for an order on the Upcomers platform.
Payments may be made using fiat currency or cryptocurrency.

Each successfully paid order represents one eligible entry into the Giveaway.Cancelled, refunded, or chargebacked orders will not be considered valid entries.Upcomers reserves the right to verify the authenticity of any entry and to disqualify entries deemed fraudulent or abusive.

3. Giveaway Period

The Giveaway will run from October 1, 2025, until June 30, 2026.

Only orders successfully placed and paid during this period will be eligible for entry.

4. Winner Selection

The winner will be selected through an automated process managed by Upcomers in accordance with fair and transparent criteria from all eligible participants who have successfully placed and paid for an order within the Giveaway period.

The selection process will be conducted at the conclusion of the Giveaway period, and the winner will be announced shortly thereafter.

Upcomers reserves the right to verify eligibility and to reject any entry that does not comply with these Terms.

5. Announcement of Winner

The winner will be publicly announced via Upcomers’ official communication channels, including but not limited to email and social media platforms, within seven (7) days following the drawing.

Upcomers may, at its sole discretion, contact the winner directly before the public announcement to confirm eligibility.

6. Prize

The winner will receive:

• A 7-day luxury trip to Dubai with accommodation at Atlantis The Royal, Dubai (5-star hotel).
• A cash prize of $10,000 USD, disbursed via a payment method designated by Upcomers.

The travel portion of the prize includes round-trip flights, hotel accommodation, and standard amenities as specified by Upcomers.
All bookings and arrangements will be managed by or on behalf of Upcomers under standard commercial terms and are subject to availability, travel restrictions, and force majeure circumstances.

Any additional personal expenses incurred during the trip, including but not limited to meals, insurance, transportation, or optional activities, are the sole responsibility of the winner.
The winner is solely responsible for any applicable taxes or fees arising from the receipt of the prize.

Upcomers does not guarantee that the prize, its timing, or specific arrangements will remain unchanged and reserves the right to replace, modify, or cancel any part of the prize at its sole discretion.

7. Verification Requirement

To claim the prize, the selected winner must complete identity verification (Know Your Customer, “KYC”) on the Upcomers platform.

The verification must be successfully completed on the same user account that was drawn as the winner.

Failure to complete KYC within the timeframe specified by Upcomers may result in forfeiture of the prize, and an alternate winner may be selected.

Upcomers reserves the right to disqualify any participant who fails to meet verification or compliance requirements.

8. General Terms

• The prize is non-transferable and may not be exchanged for any other reward, credit, or consideration.
• By entering the Giveaway, participants agree to be bound by Upcomers’ Terms and Conditions and acknowledge that all decisions made by Upcomers in relation to the Giveaway are final and not subject to appeal.
• Upcomers reserves the right, in its sole discretion, to modify, suspend, or terminate the Giveaway at any time without prior notice or reason.
• Upcomers assumes no legal obligation to provide or maintain any prize, travel arrangement, or financial reward, and participation in the Giveaway does not create any contractual or enforceable right against Upcomers.
• In the event of any dispute regarding the Giveaway, Upcomers’ decision shall be final and binding on all parties.
• Upcomers reserves the right to disqualify any participant found to be in violation of these Terms or engaged in fraudulent, deceptive, or abusive behavior.
• This Giveaway is in no way sponsored, endorsed, administered by, or associated with Instagram, X (Twitter), or any other social media platform.

9. Privacy and Data Protection

By participating in the Giveaway, entrants acknowledge and agree that their personal information may be collected, processed, and stored by Upcomers in accordance with its Privacy Policy.
Such information will be used solely for the purposes of administering the Giveaway, verifying eligibility, and communicating with participants.
Upcomers shall not be liable for any unauthorized access, loss, or misuse of data by third parties.

10. Limitation of Liability

Upcomers shall not be liable for any technical malfunctions, interruptions, delays, or other issues that may affect participation or prize delivery.

Upcomers shall not be responsible for any losses, cancellations, or changes to flights, accommodation, or other arrangements after booking.

In no event shall Upcomers be liable for indirect, incidental, or consequential damages arising from participation in the Giveaway or acceptance of the prize.

Participation in the Giveaway constitutes acceptance that Upcomers provides the Giveaway on an “as is” basis without any warranty or guarantee of any kind, express or implied.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Czech Republic.
Any disputes arising out of or in connection with this Giveaway shall be subject to the exclusive jurisdiction of the courts of the Czech Republic.
